You are wrong to think I have to give you notice every time my brother comes, as he is the one who has been doing the ongoing repairs, and you know this. On more than one occasion, I have given you his phone number to discuss the exact schedule of the repairs with him. Apparently, you never?did call him. ?On the other hand, even though I gave you notice (twice) that I was coming, you did not abide by it and were not there, or did not answer the door, on the?morning we were supposed to do a walk-through together. ? I think your brother started working on the roof of the sunroom in April or maybe May. It took him all summer to finish the roof. That translated into us not having access to the deck and full use of the sunroom for a quarter of a year. Having finished the roof, your brother then began to tear down the fence and deck. It's three months later and he still hasn't finished. There's still a rotting spot on the side of the sunroom that he hasn't repaired. It's not that he doesn't know it's there. He repaired similar spots on the top and the other side. He knows they are there. And it's not like he hasn't prowled around the entire perimeter of the house, without permission, when no one was home, looking for things to complain about, to you. Not only is the deck navailable to us, the back yard is full of things that were on the deck, and these things interfered with our use of the back yard, and its maintenance. Indeed, a lot of the work has come to a halt because we can never predict when your brother will decide to stop by for five minutes, and do just enough to work to wake people up from their naps or interrupt our routines. I don't want to deal with him. I didn't want him here. I still don't. (Call me peculiar ... but I do not trust a man who is over 50, and still dyeing his hair, even getting streaks put in his hair - no doubt, at considerable and semi-weekly expense of time and money - in a desperate attempt to present himself as something he is not. That does not lend your brother and depth of character - more, the opposite.) I put up with these inconveniences and invasions of my privacy because I understood that it was the price to pay for a good roof, and a deck that I did not have to fear falling through. Now, before it has even begun raining again, I am being told that I will not be allowed to enjoy this new roof that I financed the construction of and was significantly inconvenienced by the repair of. It seems I will never receive the benefits of the new deck, either - because the fence STILL isn't finished. Your brother is STILL showing up, at random, in the middle of the day, whenever it is convenient for him, without any notice whatsoever - you know, the ritual 48 to 72 hours' notice that is embedded in our agreement. Speaking of holes in fences - something with claws, and teeth, came through the hole in the fence, and killed my last chicken a month or so ago. (So long as there is a gap in the fencing, I'm not sure what it is - but it's not a fence, because it doesn't fence, if I'm any judge of things.) I didn't say anything about our dead pet chicken - because it seemed to be part of the price of letting your brother, Mark, work, ever so slowly, week after week after week after week after week, on finishing the deck, and, some day, the fence. And I haven't forgotten how your brother hit me, with his hat - as if he were El Jefe, and I, his humble peasant. I am personally convinced that it was your brother's suggestion that you issue the 60-day notice, now. I would not be surprised if he has been working so slowly, towards this specific end.
